      No. The law has provision for genuine pricing errors like this. Sensible really. Have had to use it myself a couple of times. Sticky "0" button meant I sent out a $5 buynow on TradeMe, should have been $500

    Hello,

    Please confirm whether the charge on my credit card was a pre-authorisation or whether it was an actual purchase. I will also call my credit card provider to confirm, so please ensure you are accurate.

    Your email - which refers to a refund, rather than the cancellation of a pre-authorisation in line with clause 6.3 of your terms of sale - suggests that the charge was a purchase, but I'll wait to hear from you and my credit card provider on that point.

    Note that clause 6.4 says that JB Hi-FI will process payment for your order immediately before dispatch, and that this process represents confirmation that the order has been accepted. In the event that payment has, in fact, been taken, the order will have been accepted and will therefore - per JB's terms - be a binding contract for sale, and incapable of cancellation under New Zealand contract law. If this is the case, and JB fails to deliver, I intend to make a complaint to the Disputes Tribunal seeking an order that JB completes my order at the agreed price, or that JB pays me the difference in price between the agreed price and the next lowest price from a reputable New Zealand seller in trade.

    Please also note that this is all without prejudice, as I expect that even if the charge was a pre-authorisation:
    the terms in your contract appear to have elements that could be considered to be unfair contract terms, particularly given the fact that the purchaser's offer is irrevocable while the vendor's discretion to cancel is unlimited; and
    there is a long standing proposition in English - and New Zealand - contract law that the more imbalanced a contract term is, the greater the degree of notice that will be required to make that notice effective.
    In particular, I draw your (or your lawyer's) attention to the following comment from the great Lord Denning:

    "The more unreasonable a clause is, the greater the notice which must be given of it. Some clauses I have seen would need to be printed in red ink on the face of the document with a red hand pointing to it before the notice could be held to be sufficient. "

    I therefore invite you to either provide the goods without delay or, at the very least, to provide me with a substantially better sweetener than early access to a sale that anyone can eventually access. A reasonable amount of JB Hi-FI credit would probably suffice.

      Yes it’s all a bit one sided , JB can cancel an order but you cannot get a refund under JB’s ‘change of mind’ terms and conditions. There has been a charge on my bank account so I thought that would be a contract of sale. When torpedo 7 made the same mistake they honoured the sale because they had excepted payment.

      • Is it definitely a charge - or is it a pre-auth?

        • Usually for a pre-auth on my asb app it shows my cheque account’s balance with no deduction, but the available funds show amount with the pre-auth charge deducted. However this one shows as balance minus the $1504, which means they have taken my money.

          I may be wrong but that’s my understanding of how pre-auth charges show on my banking app.

          It should be a charge.

          I used a westpac debit card.
          There is a transaction -1504 and now my available $ matches the balance after -1504

          They are going to refund instead of cancel the pre-auth.

          Yes it's a pending or pre-authorisation which is the same with every credit card transaction ,but the fact that I have entered into a contract to buy a product which I have to honour(I know I can cancel a credit card payment but that's only if the sale was not completed or it was fraudulent).I see it is no difference as going to shop and paying for something with a credit card and getting it at the wrong price but as advertised on a sticker ,the credit card is still charged as pending or pre-authorisation charge and the goods are mine.I would have more sympathy for JB if they didn't have that draconian policy of not refunding "change of mind".

        My position - which I suspect most ChoiceCheapies readers would vaguely agree with - is that it's pretty much moral to aggressively assert your rights against large businesses, particularly given that large businesses ruthlessly assert their rights against ordinary people.

        Obviously a lot different treating a small business in this way, which is why I would never personally try this out with a much smaller business (e.g. ExtremePC and Computer Lounge, when they had pricing problems).

        I mean, the JB Hi-Fi had a group profit after tax of A$302.3 million. That's quite a lot of money.

          Yes, but think about the poor sod who messed up adding a product to their website. They're probably new, paid (profanity), and had their mistake posted on one of, if not the largest, 'deals' website in the country.

          If that wasn't bad enough, we've now got you threatening to take the company to court unless you get your item or a 'substantially better sweetener'.

          All because you want to 'stick it to the man'.

      Lmao at the threatening legal action. Just look at section 7.3. "JB Hi-Fi reserves the right to cancel, at any time before delivery and for whatever reason, an Order that it has previously accepted. JB Hi-Fi may do this for example, but without limitation, where:
      Goods ordered were subject to an error on the Website, for example, in relation to a description, price or image, which was not discovered prior to the Order being accepted".
      Always loved reading these long winded emails from people who felt long emails try to get a point across. If you had spent an extra 2 minutes going through the rest of the terms and conditions, you could've saved the 10 minutes writing this email.

        • Not quite. The relevant question is really whether a contract has been entered into (cf. the situation where a price has merely been advertised), and then whether the terms of that contract provide a right of cancellation, and then whether the test in s 24 of the Contract and Commercial Law Act 2017 is made out.

          In this case:

          • there is a contract;
          • the terms say that JB can cancel prior to delivery, but the terms are very one-sided, and so there is at least an argument that the term is unenforcable; and
          • even if the terms are enforceable, the terms draw the line at the delivery process. The terms suggest that this begins when payment is taken (as opposed to the pre-authorisation), and so there's at least an argument that the delivery process has begun at the point they have taken payment.

          It's definitely fair that this is not necessarily the plainest interpretation on the first reading, but I reckon there's some prospect of success.

        Whilst I agree with JB being able to cancel due to pricing errors, terms and conditions are not unchallengable. Eg. They couldn't write " If you fail to pick up a click and collect the same day you are notified via email you forgo the item and it will be sold to recoup costs. If costs are not recovered you must name your first born child JBHIFI"

    To raise the issue of possible flaws in JB's terms and conditions outside of this deal I can understand.

    But doing so attached with a demand for "a substantially better sweetener" when this is clearly a pricing error is hugely pathetic, regardless of the size of the company.
