      • They’ve always refunded my purchases. First time I’ve heard of someone receiving a voucher instead.

      • I missed out on "buying" one. However, legally, from a purchase contract/agreement viewpoint, you would not had paid any consideration so no legally binding contract and one would have only paid for delivery thus, this would not to justify an actual item purchase and probably not bound by the CGA and consumer protection laws. A voucher would be something they're doing as a matter of goodwill and at their expense.

        • I think you've misunderstood my point. I wasn't suggesting they have to give you something extra if they cancel your order. I was simply saying they have to return your money. I'm very doubtful the Fair Trading Act or maybe other parts of NZ (or Australian law) allows Kogan to give you vouchers instead of returning your money if they cancel your order because of a pricing mistake.

          And this seems to be what the OP was suggestion would happen "their money tied up in a Kogan voucher". If Kogan decides to give you a voucher as a goodwill gesture as well as your money back, that's up to them but it isn't your money that's tied up in the voucher so is not a concern. You're free to ignore the voucher, the only time your money (or credit) is tied up is the time between them taking payment and them issuing a refund.

          Kogan apparently gives store credit for change of mind returns https://www.kogan.com/nz/returns-policy/ so I suspect this is what confused the OP. That's fine1 but I strongly doubted Kogan could or would do the same thing if they are the ones who cancel your order whether due to a pricing error or some other reason and we've received confirmation they didn't. If any store does try that, IMO they should be reported to the Commerce Commission at a minimum and probably called out on social media or here if you're into that. I suspect you'd also win a chargeback dispute although that may mean you're banned from the store.


          1. Unlike with some other countries, NZ doesn't require that stores allow people to cancel orders if there's no fault e.g. if they change their mind, even if it's an online order. (The UK for example requires stores allow no fault/reason cancellations within 14 days or the order being received for most distance selling including online orders. https://www.gov.uk/online-and-distance-selling-for-businesse…) Some stores notably the Warehouse do allow change of mind returns, but not all do. Likewise, where a store does allow change of mind returns, they're generally fine giving you vouchers/store credit instead of returning your money if they say so in their T&C (or doesn't say anything about change of mind returns).

      Yep, just got an email from them. The order was cancelled, money should be refunded. And they gave me $20 voucher

    But on the plus side they gave a $20 discount on my next purchase from them so that’s worth it
