Is This a Word Game? Purple Visa Card $300 Back Offer

Hey everyone,

Just wondering if anyone else had the same experience as me with the Purple Visa Card $300 back promotion by purchasing from Noel Leeming.

The deal says you get $300 back when you spend $500+ on smartphones, gaming, protection or tech services, using 12 months interest free with a new Purple or Gem Visa.

I met all the conditions — I’m a new customer, spent over $500 on eligible items, used the right credit card — but chose the 6 months interest free option instead of 12 months when placing the order online, and was later told I no longer qualify for the $300 credit.

Nowhere in the checkout process did it clearly say that picking anything other than 12 months would disqualify me from the cashback. The fine print is buried in the T&Cs, but isn’t this misleading?

Feels like a bit of a word game to avoid honouring the deal.

Has anyone else run into this? Did you manage to get it resolved?

    Just going on what is posted in the original deal:

    The deal says you get $300 back when you spend $500+ on smartphones, gaming, protection or tech services, using 12 months interest free with a new Purple or Gem Visa.

    If you don't choose the 12 month interest free option, then I'd say you don't get the $300 credit… but I could be wrong.

    Sorry for taking so long in replying to your thread - I hope you haven't cancelled your order, because you might have some grounds to argue that the T&Cs were misleading (you may wish to bring in Section 9 of the Fair Trading Act).

    The original wording on the deal itself said "with 12 months interest free" but in the context of the whole offer, it seems as though this is more of an element of the offer itself, rather than a prerequisite

    Even Noel Leeming themselves changed the wording in subsequent offers. They may have deemed it to be too ambiguous - which it was. Instead of saying "with 12 months interest free" it changed to "when you apply and spend on 12 months interest free" - but on the first offer, it used the wording of "with"

    I compared this to wording on the PB Tech $300 spend offer, and by contrast they were very clear about what the requirements were - 1. Opening a Purple Visa Account, 2. Spending more than $500 on tech, 3. Spending on 12 months interest free. This wasn't here on the first offer.

    Because you could reasonably interpret that wording of "with" as an element of the offer, rather than a prerequisite - the legal principle of contra proferentem applies here - the interpretation goes against the drafter. Noel Leeming, as a large corporation with decades of experience and lawyers on hand should realistically make their wording clearer.

    I have records of PB Tech's wording, and the original wording of the offer on hand if you needed.

    Please do your own research on the above and form your own opinion - but I believe that the phrasing of the T&Cs might be confusing. Keep this forum updated,

    Hi, thank you everyone for leaving a message here, especially thanks to @Doofus1237. As Doofus has pointed out, the initial promotion wording clearly says "with 12 months interest free", rather than the later altered "when you apply and spend on 12 months interest free". "With 12 months interest free" sounds like a bonus offer to me.

    I sent out an email to Purpler Card, and waiting for their reply now.

    I will post the progress here. Hopefully, this can help anyone who has a similar experience to mine.

  • I'm in the same boat - I don't even know at what point I selected 6 months - was it when I applied or at the shop? Do you recall when you did it Angelayaj? I am currently composing an email, how did you get on?

    • I had this problem with NL a while back but i reached out and got it sorted - i selected 6 months as well but they honoured the deal.

      I also sent some resources + photos to Angela to help her prove that the wording was unclear and misleading. Shoot me a PM and i can send them to you as well

        • I dealt with Noel Leeming, GEM visa were completely useless. However, there was a lot of bouncing back and forth between NL and Gem Visa - extremely tedious and annoying.

    Isn't their fee like 110 so you'd just be getting 190 going through all the trouble of applying?
