Reporting PB Tech to Commerce Comission?

So I've been trying to buy the Ubiquiti Unifi Access Hub for a while now. I've been keeping an eye on PB Tech's website as well as Ascent and Snappernet for it.

One day I saw the Unifi Access Hub on PB Tech said "Available for order" with an estimated delivery date of December 26.
I thought thats not too long so decided to order it.

Two days later December 26 turned to December 28
Another day later December 28 turned to February 12
Now it's March 3 estimated delivery.

I emailed them to confirm and this was their reply:

"Hey mate, this product is coming from our suppliers who don't have to adhere to strict timelines as they are not customer facing. Unfortutanly current ETA to our warehouse is late February.

If you would like me to change or cancel your order please let me know"

My boarder tells me to report them to the commerce commission but I'm not sure haha. Push back a few weeks okay but definitely not a few months imo

Luckily I've got one being air freighted to New Zealand from Ubiquiti China as I type this so I don't have to wait until March phew!

    The Comcom can't help you get anything out of this. So reporting is a selfless action.

    If it's a systemic issue affecting lots of people, they may do something.

    Bit off. But take your refund and move on I'd say. Deliveries are out of whack these days for sure.

    Doubtful comcom have any interest. There is no breach that I can see. Possibly ASA (Advertising Standards Authority) but they don't have much backbone compared to comcom. They can just growl them if they find a fault and ask them to remove the offending advertisement. The initial quote said "estimated." So that's a pretty easy out for them right there.

    Genuine mistakes are covered. If you could prove somehow they made that statement when they knew all along the initial delivery time would never happen then yeah, that's different. If they had refused a refund and said no you just have to wait, that's when comcom would be more interested.

    I don't think this is a big issue.

    For me the website says "Available on order". Definition of "on order" is "(of goods) requested but not yet received from the supplier or manufacturer.". So I would read this as that PBtech have an order in with their suppler, and you can order one for dispatch when it turns up.

    That is clickable and clearly shows they have no stock, so it depends on the suppler when they are able to fill the order.

    They seem to be regularly revising the delivery date as they get updates from their supplier.

    My main complaint would be the wording "Order now and it ships on 06/03/2023" That should have the word estimated in it.

    If somebody had ordered one, and PBTech had refused a refund when the pushed the shiping date back, Then I would feel that it warrants action.

    Nah, If anything i'd be more on the 'you're being a karen' side of the fence.

    You were advised of the changing ETAs and promptly offered a refund.

    Crap happens, ETAs get chopped and changed all the time. They're not being shady by tricking you or beating around the bush.

  • Ubiquiti is a terrible manufacturer and I believe PB Tech themselves buy Ubiquiti via Ingram Micro. It's been impossible to get accurate lead times for anything Ubiquiti for the past 12 months and the suppliers who stock it have been mislead regarding ETA's and even what is in each shipment (for example being told 20x boxes of have shipped, only to find out it's 10x boxes of another product). It is likely PB Tech were told they'd have the stock by then only to find out once it landed that it wasn't even shipped.

    To further add on to this, Ubiquiti have been trying to move to a different supply model where you buy direct from them for a few years now, they are trying to push for people to buy direct from them.
