    • AFAIK Burger King has breakfast items, until 1100 not 1030, but they otherwise serve their full menu during breakfast. I'm fairly sure I've gotten a Whopper, a BK Chicken and probably both their Angus beef and chicken fancy burgers during breakfast time.

        You need to provide an email and phone number, and your name. I see no where in the promotion page nor in the T&C https://www.burgerking.co.nz/legal or privacy policy https://www.burgerking.co.nz/corp-policies that allows them to use it to send your marketing emails or SMS if that's what I meant.

        Sometimes such promos have the option to opt-in or out of receiving marketing emails or SMS but this one doesn't seem to have, you only have to agree to the T&C. I think maybe they could even do a forced opt-in, where you agree to opt-in when you join the promotion, albeit with the option to opt out, maybe even burying it in their T&C. But again, nothing like that anywhere in relation to the promotion that I can see.

        They can collect your info and use it if you ever do agree to opt-in. They can also aggregate your info for their marketing campaigns in general.

        But if either Burger King or some third party sends your marketing emails or SMS as a result of this promotion, they've IMO violated their own T&C and Privacy Policy. If you think this has happened I'd encourage you to gather evidence e.g. next time this promotion comes around submit a mobile number and a email that you have never submitted anywhere else and when you start to receive marketing emails, send the evidence to the Privacy Commissioner. The only way we still stop such unacceptable practices is by complaining about them.

        but IMO while they say "unless you have opted out" they also say "requested to send" and there's no where in this promotion that involved a request to send.
